Welcome to Gainz + Gainz ("the App"), a fitness application designed to help you achieve your fitness goals through personalized training programs. These Terms and Conditions ("Terms") govern your access to and use of the App. By using the App, you agree to these Terms. If you do not agree, do not use the App.

1. General Information

Gainz + Gainz is owned and initially distributed by Pierre A Villanueva. Ownership of the App will be transferred to If Let LLC, at which point If Let LLC will assume all operational responsibilities. Updates to these Terms may reflect the transfer and will be communicated to users in advance.

2. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the App. By accessing the App, you confirm that you meet these requirements.

3. User Responsibilities

• Health and Safety: Consult a healthcare provider before starting any fitness program. The App does not replace professional medical advice.
• Prohibited Activities: You agree not to misuse the App, including but not limited to:
  • Reverse-engineering or attempting to extract the source code.
  • Engaging in unauthorized data collection.
  • Using the App for any unlawful or harmful purposes.

4. Subscriptions and Payments

• App Distribution: The App is distributed on the Apple App Store. All subscriptions and payments are managed through Apple's billing system.
• Free Trial: Gainz + Gainz may offer a free trial period. Details of the trial will be displayed in the App.
• Billing and Subscriptions: A valid subscription or trial is required to use the App. Subscriptions renew automatically unless canceled before the renewal date. By subscribing, you agree to Apple's payment terms and policies.
• Refunds: Refund requests must be directed to Apple, as refunds are governed by Apple's App Store refund policies.

5. Intellectual Property

All content, features, and functionality of the App—including text, graphics, software, and designs—are owned by Gainz + Gainz and its affiliates and licensors. Unauthorized use is prohibited.

6. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

7. YouTube Integration

The App includes functionality that links to YouTube for exercise demonstrations. When you search for an exercise, the App will open a webpage with a prefilled search query, displaying relevant results directly from YouTube. Gainz + Gainz is not affiliated with or endorsed by YouTube and does not guarantee the accuracy or reliability of third-party content. Your use of YouTube is subject to YouTube's Terms of Service and Privacy Policy.

8. Disclaimer of Warranties

The App is provided "as is" and "as available." Gainz + Gainz disclaims all warranties, whether express or implied, including but not limited to fitness for a particular purpose. Use of the App is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, Gainz + Gainz and its owners, successors, and affiliates shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.

10. Third-Party Services

The App may integrate with or provide links to third-party services. We are not responsible for the availability, accuracy, or content of such services.

11. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your right to use the App will cease immediately.
